We Stay Ceylon Booking Terms & Conditions

We are We Stay Ceylon ("Company," "we," "us," or "our"), a premier destination management and luxury travel company based at 252A, Galle Road, Colombo 04, Sri Lanka.

We operate the website westayceylon.com (the "Site") and provide bespoke holiday itineraries, curated vacation packages, boutique villa and hotel bookings, dedicated chauffeur-guide transport services, airport transfers, and guided cultural and wildlife excursions in Sri Lanka (collectively, the "Services").

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Traveler"), and We Stay Ceylon, concerning your access to and use of our Site and booking of our Services. By accessing our Site, submitting booking inquiries, or confirming a reservation, you agree that you have read, understood, and agreed to be bound by all of these terms.

Important Notice for All Travelers:

Travel Services & Itinerary Planning

We Stay Ceylon crafts tailor-made travel journeys across Sri Lanka. Our services include:

  • Customized, private tour itineraries for individuals, couples, families, and private groups.
  • Sourcing and reserving accommodations at luxury hotels, boutique heritage properties, tea estate bungalows, and coastal beach villas.
  • Private, air-conditioned transportation with licensed English-speaking tourist chauffeur-guides or national tour guides.
  • Arranging national park safaris (e.g., Yala, Wilpattu, Udawalawe, Minneriya), marine adventures (whale watching, surfing), scenic train tickets (e.g., Kandy to Ella), and cultural excursions (e.g., Sigiriya, Temple of the Tooth, Galle Fort).

All itineraries presented on our Site are subject to availability at the time of official booking confirmation and deposit settlement.

Booking Process & Pricing

A. Quotations: Quotes provided by We Stay Ceylon are valid for 14 calendar days from issuance, unless otherwise indicated. Prices are quoted based on prevailing currency exchange rates, government taxes (including Sri Lanka VAT, Tourism Development Levy), and supplier tariffs.

B. Inclusions & Exclusions: Every customized proposal explicitly lists what is included (e.g., accommodation with meal plan, vehicle with driver, fuel, highway tolls, entrance tickets) and what is excluded (e.g., international flights, visa fees, travel insurance, personal expenses, gratuities).

C. Currency & Taxes: Invoices may be rendered in US Dollars (USD), Euros (EUR), British Pounds (GBP), or Sri Lankan Rupees (LKR). Any statutory tax changes introduced by the Government of Sri Lanka between booking and arrival will be adjusted accordingly.

Deposits & Payment Terms

To secure and confirm your travel reservations, the following standard payment schedule applies unless otherwise specified in your formal booking voucher:

1. Deposit on Confirmation

A non-refundable or partially refundable initial deposit of 30% to 50% of the total tour cost is required to confirm hotel reservations, chauffeur allocation, and permits.

2. Balance Payment

The remaining balance is due 30 to 45 days prior to arrival in Sri Lanka (or upon arrival if explicitly agreed in writing by We Stay Ceylon for select private packages).

Payments may be completed via secure online credit/debit card portal or direct international bank telegraphic transfer (SWIFT). Any bank intermediary transaction fees are the responsibility of the remitter.

Cancellations & Refund Policy

Should you need to cancel your booked tour, written notification must be submitted via email to hello@westayceylon.com. Cancellation fees are calculated based on the date written notice is received by We Stay Ceylon:

Peak Season Note: During peak festive periods (e.g., December 15 – January 15 and Kandy Esala Perahera season), certain luxury boutique properties enforce 100% non-refundable policies 60–90 days prior to check-in. These specific supplier conditions will be noted on your proposal.

Alterations by We Stay Ceylon

While we endeavor to operate all itineraries exactly as confirmed, circumstances such as severe weather, road conditions, wildlife park closures, or unforeseen supplier issues may necessitate minor adjustments.

In the rare event of major unavoidable changes or accommodation substitutions, We Stay Ceylon will provide alternative hotels or services of equal or higher standard at no additional cost to you.

Passports, Visas & Health Requirements

A. Passports: All international travelers must possess a valid passport with a minimum validity of six (6) months from the intended date of departure from Sri Lanka, and at least two blank passport pages.

B. Visas (ETA): Travelers are solely responsible for obtaining the appropriate Sri Lankan Electronic Travel Authorization (ETA / Visa) prior to arrival via the official government portal (eta.gov.lk or official designated portal).

C. Health & Vaccinations: It is the traveler's responsibility to ensure compliance with health regulations, routine travel immunizations, and medical fitness for activities such as highland trekking, ocean sports, or safaris.

Mandatory Travel & Medical Insurance

Comprehensive international travel insurance is a mandatory condition of booking with We Stay Ceylon.

Your policy must provide comprehensive coverage against emergency medical treatment, hospital stays, emergency air evacuation/repatriation, trip cancellation and interruption, loss of personal luggage and valuables, and participation in adventure activities (e.g., wildlife safaris, scuba diving, trekking).

We Stay Ceylon is not liable for any financial loss or medical expenditure incurred due to failure to obtain comprehensive travel insurance.

Accommodations, Private Transport & Chauffeur-Guides

A. Hotel Check-in / Check-out: Standard hotel check-in time across Sri Lanka is usually 2:00 PM, and check-out is 11:00 AM or 12:00 PM. Early check-in or late check-out cannot be guaranteed unless reserved and paid for in advance.

B. Vehicles & Chauffeur Working Hours: Our private vehicles are modern, fully air-conditioned, and maintained to the highest safety standards. For the safety of our travelers and drivers, chauffeur driving hours adhere to standard tourist transport regulations (generally up to 8–10 hours per day, concluding by 8:00 PM except for pre-arranged night transfers or dinners).

Wildlife Safaris & Adventure Activities

Participation in wildlife safaris, boat excursions, ocean sports, and trekking involves inherent physical conditions. Travelers are expected to exercise personal care, listen to the safety briefings of safari trackers, park rangers, and instructors, and strictly respect wildlife by remaining inside designated safari vehicles and never feeding or harassing animals.

Cultural Etiquette, Religious Sites & Local Laws

Sri Lanka is a culturally rich country with sacred heritage. When visiting Buddhist, Hindu, Christian, or Islamic religious and sacred sites (such as the Temple of the Sacred Tooth Relic in Kandy or Anuradhapura Ancient City):

  • Modest dress is required: shoulders and knees must be covered. White or light-colored attire is customary and respected.
  • Shoes, hats, and caps must be removed prior to entering temple premises.
  • Posing with your back turned directly to a Buddha statue for photographs is strictly prohibited by law.
  • Unauthorized drone flights over archaeological monuments and national parks are strictly prohibited without prior Civil Aviation Authority permits.

Intellectual Property Rights

All content on our Site, including proprietary itinerary designs, texts, graphics, photographs, branding, trademarks, and code, is the property of We Stay Ceylon (Pvt) Ltd and protected by intellectual property and copyright laws. No part of our content or itinerary routes may be copied, reproduced, or commercialized without our prior written consent.

Prohibited Website Activities

You may not use our Site for any unauthorized or unlawful purposes, including submitting fraudulent travel inquiries, attempting unauthorized server access, scraping content, or transmitting harmful computer code.

Reviews & Testimonials

We welcome feedback and testimonials from our travelers. By submitting reviews, photos, or travel stories to We Stay Ceylon, you grant us a royalty-free license to publish and share such content on our website and social channels.

Limitation of Liability

We Stay Ceylon operates as a tour operator and agent coordinating services between travelers and independent third-party suppliers (such as airlines, boutique hotels, chartered boat operators, and railway authorities).

To the maximum extent permitted by law, We Stay Ceylon shall not be liable for any direct or indirect damages, personal injury, property loss, or flight delays caused by independent third-party suppliers or factors beyond our direct control.

Force Majeure

We Stay Ceylon is not responsible or liable for failure to perform our obligations if prevented or delayed by Force Majeure events, including natural disasters, acts of God, extreme monsoon disruptions, strikes, pandemics, government border restrictions, civil unrest, or international travel advisories. In such cases, we will actively assist in rescheduling or obtaining credits from suppliers.

Indemnification

You agree to indemnify and hold harmless We Stay Ceylon, its officers, directors, employees, and agents from any claims, damages, liabilities, or legal expenses arising from your breach of these Terms or violation of any Sri Lankan laws during your journey.

Governing Law & Dispute Resolution

These Terms and Conditions and any booking agreements entered into with We Stay Ceylon shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.

In the event of any controversy or dispute, the parties agree to first seek amicable resolution through good-faith negotiation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the competent courts of Colombo, Sri Lanka.

Miscellaneous & Severability

These Terms operate to the fullest extent permissible by law. If any provision of these Terms is deemed unlawful or unenforceable, that provision is deemed severable and shall not affect the validity and enforceability of any remaining provisions.
